PROBATE

Cacciotti Legal represents both executors and beneficiaries in all phases of trust and estate administration. Cacciotti Legal advises on the process of an initial probate of a will all the way through the final settlement of an estate. Probate is the process by which a will is proved to be valid or invalid in the probate courts. It is used to identify and gather the assets of a  deceased person, liquidate liabilities, pay  a decedent’s debts and taxes, and distribute  a decedent’s assets to  beneficiaries or heirs.

Cacciotti Legal is experienced in representing clients with all phases of probate administration, both small estate and formal administration. We assist in evaluating the estate, the appointment of an executor or executrix, identification of any exempt property, distributions, accounting and discharge once the estate is closed.

We understand the trying and difficult process of tending to the probate administration and final affairs of a loved one. If you have questions or believe issues may or have arisen in connection with an estate, there is no greater comfort than knowing your interests are protected.  Cacciotti Legal is determined to be there to help comfort, assist and if necessary litigate to protect your interest in any estate matter.

Cacciotti Legal will assist in initiating and defending lawsuits against executors or beneficiaries, including will contests, suits alleging undue influence, and suits against executors and trustees regarding the performance of their duties.

We are intimately involved with the counseling of our clients on their decision to initiate a lawsuit and, once initiated, representing their interests throughout the litigation process. Our representation even extends to include actions for or against the personal representative of an estate, as well as lifetime transfers which may have been improper or even illegal.
